It is not final, and it is not a complete win, but on Tuesday the Administrative Law Judge hearing Last Stand's challenge to Monroe County's "tier system" Tuesday issued his Recommended Order, agreeing with many of the substantive points in our case.  Both sides have a couple weeks to ask for revisions before the Final Order is issued.  Stay tuned for further details.  This news brief from the June 27 Key West Citizen:
Judge Rules Against Tier System

Administrative Law Judge Donald Alexander issued a recommended order Tuesday challenging a lot of what the county proposed for the land-management tier system, said Dennis Henize of Last Stand.

Alexander ruled in favor of most points presented by Last Stand and the Florida Keys Citizens Coalition in their challenge of the plan, Henize said.

"We are very glad that the judge agreed with us... that the county had seriously weakened the habitat protections that the tier system set out to strengthen," he said.  Assistant County Attorney Bob Shillinger could not be reached, but he said previously both sides would have 15 days to submit revisions to the order.
